Insurance Companies and Settlement Amounts
If you are one of the many people negotiating to set auto accident insurance settlements, it can seem like the numbers that they give you for settlement amounts are either brought out of thin air or deciphered from some kind of ancient scroll. There is a method to their madness however. Since a settlement is basically you giving up all legal claims against the insurance company in exchange for money, they try to figure out what a judge and jury will possibly award you and offer less than that.
The first thing that the insurance company will do is look at all the evidence that you have for your case. They try to determine how strong it is and whether it is likely to be admitted in court. For this reason, it is incredibly important that you save all the receipts and other proof from the accident that you have. Some pieces of evidence, such as the pictures of a particularly grizzly wreck can hold more weight than others. The insurance company will also look at the person affected and try to determine what type of witnesses they will make for the jury. If people, especially the plaintiff, are likely to elicit sympathy and make the judge and jury likely to award a larger amount, the insurance company in turn will offer a larger settlement.
What pops out about all of this is that there’s no one way to determine what your amount is going to be in the settlement. There are lots of attempts by different companies and people online to try to sell you products such as these, but don’t pay attention to them. If you really want to figure out what you settlement is worth, there is no replacement for a good lawyer.
